Fair Competition
Fair competition is essential for a healthy sector where businesses operate ethically, comply with regulations, and contribute to a strong economy. The CTA actively combats unfair practices that undermine legitimate businesses and exploit workers, with a particular focus on the Driver Inc. scheme. This scheme misclassifies employees as independent contractors, enabling companies to evade taxes and labor laws, creating an uneven playing field. The CTA works tirelessly with government agencies and industry stakeholders to promote a fair and competitive environment where compliant companies can thrive and workers are treated equitably.
The CTA is committed to eliminating labour and tax abuse to protect workers, ensure ethical business practices, and build a stronger, more equitable industry for all.
Priorities & Initiatives
Eliminating the Driver Inc. Scheme
The CTA is leading the charge against the Driver Inc. model, an exploitative scheme that cheats the system and creates an uneven playing field for law-abiding trucking companies. To combat this, the CTA is actively pushing for stricter enforcement of existing laws, harsher penalties for offenders, and increased funding for the CRA to investigate and prosecute Driver Inc. schemes. This includes calling for a “real enforcement strategy” from the CRA to deal with non-compliant Personal Service Businesses (PSBs) and urging the CRA to lift the T4A enforcement moratorium to enhance transparency and accountability. Furthermore, the CTA is advocating for more enforcement of Canada Labour Code Part III as it relates to trucking, through the ESDC Labour Program.
Protecting Workers’ Rights
We are actively working to combat wage theft, promote fair wages and benefits, and ensure that all workers have access to safe and healthy working conditions. In addition to addressing labor shortages by promoting trucking careers and improving training opportunities, the CTA is also pushing for stronger consequences for employers who violate labor laws. This includes supporting the ESDC’s proposal to “substantially increase the penalties imposed on federally regulated employers who commit wage theft.” The CTA also recognizes the need for adequate resources to address these issues and is advocating for increased CRA funding for audits to combat the underground economy, particularly in relation to the Driver Inc. scheme.
Enhancing Industry Compliance
To ensure a fair and sustainable trucking industry, the CTA is committed to raising the bar for compliance. We are working diligently to educate trucking companies and drivers on their legal obligations and best practices. This goes hand-in-hand with our close collaboration with enforcement agencies, including the CRA and ESDC, to identify and address non-compliant operators. By promoting industry best practices and advocating for stronger enforcement, the CTA is working to create a culture of compliance within the Canadian trucking industry.
