CTA Update – Arkansas House Bill 1745

The purpose of this note is to provide clarification to the CTA membership on an issue from the State of Arkansas that has been reported in the trade press.

CTA and the American Trucking Associations have been monitoring the situation, along with council experienced in cross-border trucking issues and government officials.

Here is what we know based on our conversations to date:

  • Arkansas House Bill 1745, now Act 605 went into effect April 15, 2025.
  • The Act is based loosely on Texas law that has been on the books for over two years, which is designed to address truck drivers working illegally in the State of Texas.
  • The Arkansas Act makes specific references to drivers’ licenses and work permits and requirements for foreign truck drivers. It also references the English language.
  • It is understood Federal pre-emption should apply in this instance where States are prohibited from interfering with interstate or international commerce.
  • International commerce is not considered work in the U.S.  Work in the United States would be considered domestic movements, which are not permitted for Canadian drivers and carriers.
  • The intent of the Act is not to target Canadian truck drivers engaged in international commerce; it is to address truck drivers working illegally in the State of Arkansas.   Canadian truck drivers are allowed to patriciate in international commerce.
  • English Proficiency has been part of the Federal Motor Carrier Safety Regulations 391.11(b) 2 General driver qualifications for decades.
  • CTA / ATA will be monitoring situation; carriers are asked to notify CTA immediately at Arkansas1745@cantruck.ca if they experience any issues.
  • Additional updates will be provided if necessary.
