ECCC Issues Interim Order to Align Heavy-Duty Vehicle Emissions Regulations with U.S. Standards

Environment and Climate Change Canada (ECCC) has issued an interim order under the Canadian Environmental Protection Act, 1999 (CEPA) to maintain alignment with U.S. EPA air pollutant emission requirements, minimize administrative and compliance burdens, and provide regulatory certainty for Canada’s trucking and trailer manufacturing industries.

Based on discussions with manufacturers, ECCC expects Canadian industry to support the Interim Order, which is intended to maintain regulatory alignment with U.S. EPA requirements, reduce compliance burdens and provide greater certainty for stakeholders.

The Interim Order was made on October 13, 2026, approved by the Governor in Council on October 23, 2026, and is effective for up to one year.

Key changes include:

  • Heavy-duty trailers: Suspends the application of GHG emission standards under the Heavy-duty Vehicle and Engine Greenhouse Gas Emission Regulations, continuing the suspension of these requirements for trailer manufacturers.
  • Heavy-duty trucks and engines: Modifies the On-Road Vehicle and Engine Emission Regulations to maintain alignment with U.S. EPA air pollutant emission standards and update references to the U.S. Code of Federal Regulations.
  • 2027 and newer models: Updates regulatory references to recognize applicable U.S. EPA certification standards for heavy-duty vehicles and engines, allowing EPA-certified vehicles and engines to continue to be recognized in Canada.

ECCC plans to develop permanent regulatory amendments to address Canadian-U.S. emissions regulatory misalignments, including trailer GHG standards and on-road vehicle and engine emissions requirements. These amendments will follow the CEPA regulatory process, including a formal comment period, with continued industry consultation.

ECCC also confirms that it continues to engage regularly with Canadian trailer manufacturers, the trucking industry and their associations.
