{"id":3291,"date":"2022-01-14T17:10:08","date_gmt":"2022-01-14T17:10:08","guid":{"rendered":"https:\/\/cantruck.ca\/us-supreme-court-stays-osha-domestic-vaccine-mandate\/"},"modified":"2025-01-10T16:43:39","modified_gmt":"2025-01-10T16:43:39","slug":"us-supreme-court-stays-osha-domestic-vaccine-mandate","status":"publish","type":"post","link":"https:\/\/cantruck.ca\/fr\/us-supreme-court-stays-osha-domestic-vaccine-mandate\/","title":{"rendered":"US Supreme Court Stays OSHA Domestic Vaccine Mandate"},"content":{"rendered":"<div>\n<p><span style=\"font-size: 16px;\">The U.S. Supreme Court halted enforcement of the Biden administration\u2019s emergency rule that would have required US business with more than 100 employees to require workers to have COVID-19 vaccines or undergo weekly testing.<\/span><\/p>\n<\/div>\n<div>\n<p>The unsigned opinion came just days after the court heard an<span class=\"apple-converted-space\">\u00a0<\/span><a href=\"https:\/\/www.truckinginfo.com\/10158755\/supreme-court-to-hear-vaccine-mandate-challenge-this-week\" target=\"_blank\" rel=\"noopener\">emergency appeal last Friday<\/a>. The rule, an \u201cemergency temporary standard,\u201d would have affected more than 84 million workers. The trucking industry was among those that had challenged the mandate, and it was quickly<span class=\"apple-converted-space\">\u00a0<\/span><a href=\"https:\/\/www.truckinginfo.com\/10155697\/vaccine-mandate-on-hold\" target=\"_blank\" rel=\"noopener\">put on hold by an appeals court<\/a>, reports Truckinginfo.com<\/p>\n<\/div>\n<div>\n<p>The Occupational Safety and Health Administration published the ETS in early November, arguing that the mandate was needed to ensure workplaces were safe for employees in the face of the COVID-19 pandemic. The administration said a 1970 law permits the agency to set an emergency rule when a \u201cgrave danger\u201d exists that could expose workers to \u201csubstances or agents determined to be toxic or physically harmful or from new hazards.\u201d<\/p>\n<\/div>\n<div>\n<header class=\"col-md-8 col-lg-9 col-center align-center padding-bottom-30\">The majority of justices disagreed, saying the agency had overstepped its authority.<\/p>\n<p>\u201cAlthough Congress has indisputably given OSHA the power to regulate occupational dangers, it has not given that agency the power to regulate public health more broadly,\u201d the court wrote. \u00ab\u00a0Requiring the vaccination of 84 million Americans, selected simply because they work for employers with more than 100 employees, certainly falls in the latter category.\u201d<\/p>\n<p>American Trucking Associations President and CEO Chris Spear issued a statement calling it \u201ca tremendous victory.\u201d<\/p>\n<p>\u201cTrucking has been on the front lines throughout the pandemic \u2013 delivering PPE, medical supplies, food, clothing, fuel, and even the vaccines themselves,\u201d Spear said. \u201cThanks to this ruling, our industry will continue to deliver critical goods, as our nation recovers from the pandemic and we move our economy forward.\u201d<\/p>\n<p>The news comes on the heels of OSHA publishing a frequently asked question about the mandate confirming that most solo truck drivers would have been<span class=\"apple-converted-space\">\u00a0<\/span><a href=\"https:\/\/www.truckinginfo.com\/10159402\/osha-some-truck-drivers-exempt-from-covid-19-vaccine-or-test-mandate\" target=\"_blank\" rel=\"noopener\">exempt from the
