{"id":3053,"date":"2021-02-05T20:23:59","date_gmt":"2021-02-05T20:23:59","guid":{"rendered":"https:\/\/cantruck.ca\/latest-court-ruling-bolsters-carriers-right-to-implement-enforce-random-testing\/"},"modified":"2025-01-10T16:44:31","modified_gmt":"2025-01-10T16:44:31","slug":"latest-court-ruling-bolsters-carriers-right-to-implement-enforce-random-testing","status":"publish","type":"post","link":"https:\/\/cantruck.ca\/fr\/latest-court-ruling-bolsters-carriers-right-to-implement-enforce-random-testing\/","title":{"rendered":"Latest Court Ruling Bolsters Carriers\u2019 Right to Implement &#038; Enforce Random Testing"},"content":{"rendered":"<p class=\"x_MsoNormal\">An Alberta judge\u2019s recent ruling in favour of a motor carrier has once again reinforced the legitimacy of random testing for truck drivers as a matter of policy.<\/p>\n<p class=\"x_MsoNormal\">Justice Dunlop, of the Court of Queen\u2019s Bench of Alberta, dismissed \u200ean application in its entirely against Westcan Bulk Transport by a former employee over a compliant about random drug &amp; alcohol testing. The judge ruled in favour of the carrier to conduct the tests and refused to issue a temporary injunction or to order any compensatory damages to the plaintiff.<\/p>\n<p class=\"x_MsoNormal\">Citing the bona fide operational requirement (BFOR) standard set in the landmark \u2018Entrop\u2019 case in Ontario, the judge stated that a driver can\u2019t complain \u201cafter the fact\u201d about a company\u2019s drug testing policy and refuse to be part of the program. (The plaintiff understood random testing would be a condition of his employment when he returned to the carrier in 2015 even though it wasn\u2019t explicitly stated in the employment contact).<\/p>\n<p class=\"x_MsoNormal\">Even more noteworthy, perhaps, the ruling goes on to say that such a policy would be equally legitimate if it were introduced post-employment as part of a company\u2019s safety obligations under either the Ontario Court of Appeal\u00a0Entrop\u00a0test (for non-union employees) or the stricter\u00a0Irving\u00a0Supreme Court of Canada\u00a0test (for unionized \u200eemployees subject to a collective bargaining agreement).<\/p>\n<p class=\"x_MsoNormal\">While many companies already have such programs spelled out in employment\/safety policies, observers of the case tell CTA and OTA that the latest ruling provides helpful direction to a company with similar safety-related work that wanted to move into random testing.<\/p>\n<p class=\"x_MsoNormal\">Observers tell CTA that although there might have been some risk with the court taking a very strict interpretation, that employment contacts must expressly state random testing to be enforceable, this latest ruling \u2013 combined with a similar case (Autocar Connoisseur) before the Federal HR tribunal, which stated that drivers can all be covered with a random program no matter where they operate \u2013 further bolsters carriers rights to enforce, as well as implement, random testing for drivers as BFOR.<\/p>\n<p class=\"x_MsoNormal\">Read the full ruling of the case <a href=\"https:\/\/www.canlii.org\/en\/ab\/abqb\/doc\/2020\/2020abqb764\/2020abqb764.html?resultIndex=1\">here<\/a>.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>An Alberta judge\u2019s recent ruling in favour of a motor carrier has once again reinforced the legitimacy of random testing for truck drivers as a matter of policy.
