{"id":2730,"date":"2019-12-04T20:07:14","date_gmt":"2019-12-04T20:07:14","guid":{"rendered":"https:\/\/cantruck.ca\/cvsa-dec-17-eld-deadline-is-real\/"},"modified":"2025-01-10T16:46:26","modified_gmt":"2025-01-10T16:46:26","slug":"cvsa-dec-17-eld-deadline-is-real","status":"publish","type":"post","link":"https:\/\/cantruck.ca\/fr\/cvsa-dec-17-eld-deadline-is-real\/","title":{"rendered":"CVSA: Dec. 17 ELD Deadline is Real"},"content":{"rendered":"<p><span lang=\"EN-US\">The Commercial Vehicle Safety Alliance is reminding the Dec. 17 ELD rule deadline is just days away and emphasized there will be no extensions, exceptions for <\/span><span lang=\"EN-US\">motor carriers and truck drivers who are subject to the rule. <\/span><b><\/b><\/p>\n<p><span lang=\"EN-US\">The Dec. 17 deadline specifically pertains to grandfathered automatic onboard recording devices, which will no longer be allowed for recording duty status as a substitute for a mandated ELD. In other words, all carriers subject to the ELD rule that are now using an AOBRD must have a fully operational ELD installed before Dec. 17.<\/span><i><\/i><\/p>\n<p><span lang=\"EN-US\">CVSA also pointed out that roadside inspectors will begin fully enforcing the ELD rule on that day and emphasized there will be no \u00ab\u00a0soft enforcement\u00a0\u00bb grace period.<\/span><\/p>\n<p><span lang=\"EN-US\">If a commercial motor vehicle driver is required to have an ELD and the vehicle is not equipped with a\u00a0registered\u00a0compliant ELD, the driver is considered to have no record of duty status; that also applies to a driver still using an automatic onboard recording device after the AOBRD to ELD transition deadline of Dec. 17.<\/span><\/p>\n<p><span lang=\"EN-US\">According to the North American Standard Out-of-Service Criteria, a property-carrying driver who does not have a record of duty status in his or her possession when one is required will be declared out of service for 10 hours.<\/span><\/p>\n<p><span lang=\"EN-US\">CVSA-certified roadside inspectors use the\u00a0North American Standard Out-of-Service Criteria\u00a0to identify conditions that preclude further operation of a commercial motor vehicle by its driver for a specified amount of time, or for some conditions, until the violation is corrected.<\/span><\/p>\n<p><span lang=\"EN-US\">CVSA also noted that the April 1, 2019, North American Standard Out-of-Service Criteria specifies the out-of-service conditions related to deficiencies of record-of-duty status and hours-of-service rules and regulations. In addition, CVSA&rsquo;s\u00a0Inspection Bulletin\u00a0regarding hand-held and electronic logging devices outlines the requirements for devices used to record drivers&rsquo; hours of service, according to\u00a0<a href=\"https:\/\/www.ecfr.gov\/cgi-bin\/retrieveECFR?=PART&amp;gp=1&amp;h=L&amp;mc=true&amp;n=pt49.5.395&amp;ty=HTML#sp49.5.395.b\">49 CFR Part 395 Subpart B \u2013 Electronic Logging Devices<\/a>.<\/span><\/p>\n<p><span lang=\"EN-US\">\u201cIt&rsquo;s important to note that the ELD final rule does not change any of the underlying hours-of-service regulations,\u201d CVSA
