Players"},"content":{"rendered":"<p>Driver Inc. \u201cis a sham\u201d that \u201crips off drivers and taxpayers\u201d, says a transportation lawyer with Fernandes Hearn LLP, urging that anyone engaged in the unlawful particle change their ways before Canada Revenue comes knocking on their doors.<\/p>\n<p>The <a href=\"https:\/\/cantruck.ca\/driverinc\/\">Driver Inc. model<\/a> is an illegal labour classification mechanism through which many unsafe and noncompliant fleets fuel their growth. It allowing employers to sidestep source deductions and employee drivers to claim business tax benefits they\u2019re not entitled to.<\/p>\n<p>Speaking at the ISB Global Biz and Breakfast this week, Kim Stoll, had some strong advice for truckers operating under Driver Inc, reports <em>Truck News:<\/em><\/p>\n<p>\u201cI know it sounds ominous, but (CRA) are coming,\u201d she said of Canada Revenue Agency (CRA). \u201cAnd rightfully so, because Driver Inc., when set up in that manner is a sham. It rips off drivers and it rips off taxpayers.\u201d<\/p>\n<p>Although CRA has so far not put a lot of <a href=\"http:\/\/ontruck.org\/ont-wsib-assesses-dozens-more-driver-inc-companies-but-where-is-ottawa\/\">effort into enforcement<\/a>, Stoll thinks that\u2019s about to soon change. \u201cThe taxman will come,\u201d she warned.<\/p>\n<p>She urged drivers in that scenario to review the <a href=\"https:\/\/www.canada.ca\/en\/revenue-agency\/services\/forms-publications\/publications\/rc4110\/employee-self-employed.html#mpl_slf_mpld_wrkr\">CRA website<\/a> to determine if they are truly an independent contractor.<\/p>\n<p>Asked if drivers will have any legal recourse against their employer, if they\u2019ve been led to believe this arrangement is legal, Stoll said this:<\/p>\n<p>\u201cWe haven\u2019t seen that yet. I\u2019m sure that will come,\u201d she said. \u201cEverybody is responsible for their own activity\u2026You\u2019re responsible for the decisions you make and the contracts you sign.\u201d<\/p>\n<p>But she said drivers could file civil cases against their employers, on the grounds of \u201cundue influence or some sort of employment contract breach.\u201d<\/p>\n<p>Full Truck
