{"id":2129,"date":"2017-03-16T20:08:39","date_gmt":"2017-03-16T20:08:39","guid":{"rendered":"https:\/\/cantruck.ca\/sandberg-us-eld-rule-on-schedule-other-proposed-regs-could-be-in-limbo\/"},"modified":"2025-01-10T16:49:38","modified_gmt":"2025-01-10T16:49:38","slug":"sandberg-us-eld-rule-on-schedule-other-proposed-regs-could-be-in-limbo","status":"publish","type":"post","link":"https:\/\/cantruck.ca\/fr\/sandberg-us-eld-rule-on-schedule-other-proposed-regs-could-be-in-limbo\/","title":{"rendered":"Sandberg: US ELD Rule on Schedule; Other Proposed Regs Could Be in \u2018Limbo\u2019"},"content":{"rendered":"<p>While major trucking regulations such as the electronic logging device mandate are on schedule, other proposed rules will be subject to review as part of the Trump administration\u2019s regulatory freeze \u2013 and some could be dropped altogether, says former FMCSA administrator Annette Sandberg.<\/p>\n<p>Featured in <a href=\"http:\/\/pages.fleetowner.com\/trump-and-trucking-regulations?partnerref=foinvite1&amp;utm_rid=CPENT000002498839\">the latest Fleet Owner\/Omnitracs\u00a0webinar<\/a>, Sandberg, now principal at TransSafe Consulting LLC, described several recent and upcoming federal transport regs to be in \u201climbo\u201d. She said President Trump\u2019s \u201ctwo-for-one\u201d executive order (under which two existing rules must be dropped before a new one can imposed) is \u201ccausing pause\u201d in the regulatory pipeline, reports Fleet Owner.<\/p>\n<p>\u201cSo if you\u2019ve wondered why DOT hasn\u2019t done anything, these executive orders basically halted any regulations from coming out,\u201d she said.<\/p>\n<p>Published in 2015 and due to take effect in December, Sandberg called the ELD mandate \u201cthe big one.\u201d She noted that while the agency has yet to finalize \u201cthe data transfer piece,\u201d especially with regard to supplier self-testing and the impact on the enforcement community, she expects the rule to move forward more or less as planned.<\/p>\n<p>\u201cWhat we\u2019re hoping is FMCSA will work out some of the logistical problems and make sure federal and state enforcement people are fully trained, and that when fleets begin to implement this on a broader basis that everybody is ready and it goes off without any major problems.\u201d<\/p>\n<p>She said that although there is always the potential of \u201canother surprise\u201d with \u201cthis administration,\u201d she doesn\u2019t expect major delays at this time and added non-ELD fleets should definitely be proceeding under the expectation that it is going to take effect this year. \u201cThere\u2019s a learning curve with this type of technology. This is not something you can switch to overnight and be successful.\u201d<\/p>\n<p>There are bigger questions surrounding other proposed rules, however<strong>. <\/strong>FMCSA and the National Highway Traffic Safety Administration last fall published an NPRM on mandatory speed limiters that famously did not specify the speed at which to limit commercial vehicles.<\/p>\n<p>\u201cThis one\u2019s going to be held up,\u201d Sandberg said. \u201cKeep in mind: If the agency wants to issue it, they\u2019re going to have to find two that they\u2019re going to eliminate. So, the 2-for-1 is going to impact some of these regulations whether people want to see them or not.\u201d<\/p>\n<p>Obstructive Sleep Apnea is another rule that could be delayed. FMCSA last year published an Advance NPRM but, given the current reform environment, \u201cabsent significant scientific data, this one\u2019s going to take a back burner,\u201d Sandberg
