But the court rejected OOIDA\u2019s argument that the rule is \u201carbitrary or capricious\u201d or violates truckers\u2019 Fourth Amendment rights to privacy. The court also dismissed the plaintiff\u2019s notion the rule didn\u2019t meet standards set by Congress for an ELD mandate.<\/p>\n
The 7th Circuit Court of Appeals \u2013 considered the highest court in the U.S. next to the Supreme Court \u2013 is the same court that tossed out FMCSA\u2019s 2010-published ELD mandate on the grounds that the rule didn\u2019t do enough to protect truckers from harassment by carriers via the devices.<\/p>\n
