{"id":1876,"date":"2016-01-22T20:04:18","date_gmt":"2016-01-22T20:04:18","guid":{"rendered":"https:\/\/cantruck.ca\/1317-2\/"},"modified":"2025-01-10T16:51:20","modified_gmt":"2025-01-10T16:51:20","slug":"1317-2","status":"publish","type":"post","link":"https:\/\/cantruck.ca\/fr\/1317-2\/","title":{"rendered":"US Driver-Coercion Rule Takes Effect End of Jan"},"content":{"rendered":"<p>The new rule in the U.S. prohibiting companies from pushing truck drivers to violate federal safety regulations takes effect Jan. 29.<\/p>\n<p>The so-called \u201ccoercion rule\u201d \u2013 officially knowns as the \u201cProhibiting Coercion of Commercial Motor Vehicle Drivers\u201d rule \u2013 specifically forbids motor carriers, shippers, receivers, brokers or any other transportation intermediary from coercing CDL holders to violate certain provisions of the Federal Motor Carrier Safety Regulations.<\/p>\n<p>According to FMCSA, <a href=\"https:\/\/www.fmcsa.dot.gov\/safety\/coercion\">the final rule addresses three key areas concerning driver coercion<\/a>:<\/p>\n<ul>\n<li>Procedures for commercial truck and bus drivers to report incidents of coercion to FMCSA<\/li>\n<li>Steps the agency could take when responding to such allegations<\/li>\n<li>Penalties that may be imposed on entities found to have coerced drivers.<\/li>\n<\/ul>\n<p>Heavy Duty Trucking reports that penalties can include fines of up to $16,000 for each offense.<\/p>\n<p>\u201cAny time a motor carrier, shipper, receiver, freight-forwarder, or broker demands that a schedule be met, one that the driver says would be impossible without violating hours-of-service restrictions or other safety regulations, that is coercion,\u201d said FMCSA Chief Counsel T.F.
