Claims FMCSA Spin in HoS Restart Review"},"content":{"rendered":"<p>The American Trucking Association is accusing the Federal Motor Carrier safety Admin of \u201ccherry-picking\u201d a few points in a recent GAO review of the changes made to the 34-hour restart provisions of the HOS rule in order to \u201cinfluence lawmakers.\u201d<\/p>\n<p>As reported by Heavy Duty Trucking, <a href=\"http:\/\/www.truckinginfo.com\/news\/story\/2015\/07\/fmcsa-supports-gao-recommendations-for-hos.aspx\">FMCSA said on July 30<\/a> that it agreed with certain aspects in the GAO report that stated the changes FMCSA made to the HOS rules improve highway safety by saving lives and lowering the risk of driver fatigue.<\/p>\n<p>In addition, FMCSA advised that the GAO report also recommended that the Dept. of Transportation \u201cadopt formal guidance outlining Agency research standards\u201d and that Congress should consider \u201cdirecting DOT to study and report on how electronically collected driver schedule data can be extracted, stored, and analyzed in a way that addresses cost and privacy concerns.\u201d<\/p>\n<p>The FMCSA\u2019s changes to the 34-hour restart were vacated in late 2014 and the rules <a href=\"https:\/\/cantruck.ca\/us-hours-of-service-resets-revert-back-to-old-rules\/\">reverted back to its original reset provision<\/a> and suspended the provision that limits drivers to the use of the reset more than once per week.<\/p>\n<p>That decision was supported by a majority of trucking industry groups, including ATA.<\/p>\n<p>ATA claims that FMCSA in its latest statement \u201cignored the bulk of the Government Accountability Office\u2019s report on the agency\u2019s 2013 hours-of-service changes\u201d and focused only on a \u201chandful of points\u201d that cast the rule change positively.<\/p>\n<p>\u201cIt is unfortunate that rather than present an accurate and balanced characterization of the GAO report, FMCSA is once again living in Spin City,\u201d said ATA Executive Vice President Dave Osiecki.<\/p>\n<p>In making its point, ATA detailed at length additional elements of the GAO report that appear to counter FMCSA\u2019s contention that the restart was safer before reverting back to the old rules.<\/p>\n<p>Read full HDT <a
